An Auburn, Washington woman is accused of severely injuring a baby boy and causing a brain injury when she became frustrated and roughly placed him on the ground. Dottie Reed, 18-years old, reported to the police that she became angry and upset at the young boy she was babysitting because he was always fussy and did not appear to like her. This incident occurred on May 28, 2010.

Reed told police officers that she grabbed the roughly placed him on the ground. This forced his head to snap back because it was not properly supported. She then lay the child down which caused his head to come forward. This back and forth movement of the neck is commonly referred to as a whiplash motion and is responsible for many injuries in adults. In a baby’s thin and weak neck, such movement can cause brain injuries and death.

Reed called 911 in the morning when she heard the boy cry, go back to sleep, and then start breathing loudly. Paramedics took the infant boy to Children’s Hospital where he was found to have suffered a severe brain injury that was perhaps life threatening. Police have charged Reed with first degree assault.

Anyone who is around babies for any appreciable length of time understand that supporting the neck and head is crucial because the neck has not developed enough to support the weight of the head. If the head is not supported, then a severe brain injury can happen when the spinal cord becomes compromised. We hope for the best for the injured infant and hope that he is able to completely recover without any long term side effects.

Linden Feldman, a 44- year old software engineer, took his kids to Scout-O-Rama sponsored by Santa Clara Council at Kelly Park on May 9, 2009. The Boy Scouts provided a zipline ride with a safety harness to grip the riders as they jump over 25-foot high tower and then zipped down a wire at the speed of nearly 40 mph. As a result of using the zipline tower, Feldman became injured and has recently filed a lawsuit against the Boy Scouts in Santa Clara County Superior Court.

According to the lawsuit, Feldman alleges that the safety harness was a thin nylon piece that could only support kids and not adults like Feldman. Feldman states that he was not told he and other adults could not use the zipline due to weight restrictions. When Feldman attempted to use the zipline, the line broke and he ended up jumping from the tower and slammed to the ground 25 feet below. He was in coma for a week with a traumatic brain injury, respiratory failure and a collapsed lung. Feldman has filed a law suit against the Boy Scouts as their safety preparations were insufficient to allow people like Feldman to use the zipline.

We hope that Feldman recovers from his injuries. Traumatic brain injuries can have very long-lasting and devastating effects. We hope that the lawsuit brings out the facts and that Feldman receives the compensation he deserves.

Washington State researchers have found that severe depression within the first year of a suffering a traumatic brain injury is common. Studies indicate that the incidence of major depression among 559 people with traumatic brain injury was nearly eight times greater than would be expected in the general population.

Major depression during the first year of a traumatic brain injury led to a poorer quality of life and ability to carry out normal function. An estimated three million Americans are currently living with a traumatic brain injury. The most common cause is automobile accidents.

Usually brain injury treatments are focused on the injury and its effect on a person’s ability to think clearly. However, the consequent severe depression can cause negative effects on the recovery. Of the 1,080 brain injury patients admitted to one trauma center in Seattle between June 2001 and March 2005, 559 agreed to participate in the study and were followed for 12 months. Study participants were mostly men injured in automobile accidents. In the first year of brain injury, it was found that more than half of the participants (about 53 percent) were diagnosed with major depression.

Sabino Robles, 36, of Live Oak, was riding on his Honda Four Trax ATV with his 2-year old son seated on his lap in an agricultural field on County Road 85 in Dunnigan. Neither of the riders was wearing the proper safety equipment at the time of the accident.

It was around 6:50 p.m. on May 5, 2010, when riding through the field, Robles lost control his Honda. The all-terrain vehicle rolled over on its left side ejecting both passengers.

The young boy sustained major head injuries and was taken by helicopter to UC Davis Medical Center in Sacramento. Despite the quick rescue action the child could not be saved and was declared brain dead by hospital on Friday night. Robles suffered minor injuries. An investigation into the matter is currently under way.

Our sympathies go out to the Robles family. It is always devastating when a child is killed and it is even more devastating when a family member may be responsible. I am sure Mr. Robles feels very guilty about causing the accident, whether or not that is true. Parents tend to punish themselves. However, this accident is a good lesson to everyone not to ride on ATVs or motorcycles with young children. Riders are exposed to injuries on these vehicles and a young child cannot protect himself from danger.

Over 1,100 brain injury patients across California are set to benefit from recent developments in hormone therapy. To be implemented in 17 hospitals initially, the treatment involves the use of the sex hormone, Progesterone.

In a hope to limit the cell death which comes after a traumatic brain injury (TBI), an IV drip containing Progesterone will be administered because it is believed that the hormone has some cell protective properties, thereby not letting the brain cells die after a trauma. The practical application of the treatment may prove to be troublesome as informed consent is an issue.

We hope that this hormone treatment proves to be an effective cure of minimizing the degenerative effect caused by brain injury, and those who suffer from TBI due to fatal accidents and falls find some relief.

A 24-year old woman suffered a serious brain injury in a San Diego bicycle accident that took place on April 17, 2010 around 11:50 a.m. The bike accident occurred on Genesee Avenue at La Jolla Village Drive near Westfield University Towne Center.

The victim was riding her cycle when she was hit by a 2004 Infiniti sedan. She was northbound on Genesee when the westbound driver slammed into her causing severe head trauma. The victim was taken to the hospital. Her injuries are said to be non life threatening.

Our office wishes a quick recovery to the injured woman. We hope and pray that she heals completely and comes out of this accident totally recuperated. Cyclists must make it a point to wear helmets. That is the least amount of safety measure a cyclist can take. Keep in mind that anyone who suffers a severe head injury risks the chance of brain injury which includes long term symptoms that can affect the victim for the rest of their life.

Professional triathlete Jordan Rapp suffered a traumatic brain injury in a Los Angeles County bicycle accident in Oxnard on March 23, 2010 around 5:40 p.m.

Professional triathlete Jordan Rapp suffered a traumatic brain injury in a Los Angeles County bicycle accident in Oxnard on March 23, 2010 around 5:40 p.m.

Rapp was riding his bicycle at the intersection of Lewis Road and Old Lewis Road when he got struck by a car. California Highway Patrol offers believe that the accident happened when a vehicle crashed into the side of Rapp’s bicycle while it was making a “left-hand turn” into oncoming traffic. Rapp was taken to St. John’s Medical Center where he was kept in the ICU and received treatment for severe contusions and lacerations on his head and neck along with numerous broken bones. He also lost around three liters of blood.

Our office wishes Rapp a quick recovery. We hope he gets well real soon and is at his athletic best. It is rather sad that the guilty driver did not even bother to stop and help him out! Car drivers need to be very careful while driving and ensure that they share the road with other drivers and riders. It is because of this basic lack of understanding that accidents take place and people get hurt. In addition, drivers need to pay attention to pedestrians and bicyclists while driving—not just other motor vehicles.

A new bill under consideration before the California legislature may require young skiers under the age of 18 to wear safety gear like helmets while skiing or snowboarding on the ski slopes of California.

The legislation has been proposed by Leland Lee, a San Francisco and San Mateo County’s state senator. The growing number of serious head injuries in skiing and snowboarding accidents, along with rising medical costs for the long-term care of brain injury victims, is expected to lead to the passage of this bill. Along with this bill, another bill has been proposed by a Sacramento Assemblyman Dave Jones to place the responsibility and enforcement of youth ski helmets upon ski resort operators.

Thrill seeking skiers and libertarians are understandably not too excited these laws. But the fact of the matter remains that every year hundreds of people get seriously hurt with brain injuries while skiing. In fact, actress Natasha Richardson suffered a traumatic brain injury while skiing last year when her head hit the snow on the bunny slope of an Idaho resort. If such a benign force can result in death, maybe wearing helmets may be a good idea. However, we are not a fan of the idea of placing responsibility, which will lead to civil liability in future lawsuits, against ski resort operators. Such laws only restrict the number of ski resorts that will operate in California, increase insurance costs, and increase the price of lift tickets for skiers and snowboarders.

The New York Times recently investigated the long term affect of concussions suffered by NFL players, focusing on former NFL players and their cognitive behavior. Utilizing a recent study by the University of Michigan’s Institute for Social Research that included interviews of 1,063 former NFL players, the Times reported that 6.1 percent of former players aged 50 and older had received dementia-related diagnosis. That is five times the national average of 1.2 percent.

The NFL is working on their own study and correctly points out that this elevated reporting may be due to the players self reporting their diagnosis. Nevertheless, it seems that the findings are consistent with existing concussion research for those who suffer from repeated closed head injuries. At the very least it seems that the issue deserves further study as even small bumps to the head may lead to serious brain damage and even death. The science is established, yet more is learned every day and with more knowledge comes the discovery of more long term damage.

Over 1.5 million people suffer mild traumatic brain injuries (MTBI) each year and MTBI leads to nearly 50,000 deaths per year. Closed head trauma is typical cause for MTBI injuries. More severe injuries to the head, including fractures and swelling of the brain that require surgical pressure relief lead to conditions known as traumatic brain injury (TBI). Given that TBI injuries result in more objective signs of injury, TBI injuries are easier to diagnose than MTBI and have a greater impact on the life of their victim.

Concussions are one type of TBI injuries, along with diffuse axonal injury, contusion, and coup-contrecoup injury. With the exception of contusions of the brain and concussions, football typically does not cause these kinds of injuries. The typical cause is some sort of intentional act or accident.

At our San Diego based California personal injury law firm, we see many MTBI and TBI injuries as a result of car accidents, motorcycle crashes, and bicycle accidents. Car vs. pedestrian accidents often cause brain injuries as well when the skull of a pedestrian strikes the hood or windshield of the automobile.

If someone you know has been involved in an accident or has suffered an assualt and you suspect that he has suffered a MTBI or TBI injury due to slow cognitive skills and memory loss, it is crucial that you have a qualified medical specialists examine the injured person immediately. Please read this article for an explanation of brain injury symptoms.
